Terms and Conditions

This agreement is between user and Book Beach International PC hereinafter referred to as "Bookbeach", "Company", "we", "our" or "us".

The use of bookbeach.app is subject to the user acceptance and compliance with the below mentioned terms and conditions and any applicable local laws and regulations.

If the user does not agree to any of the Terms and Conditions herein set forth, the user may not use this App or refrain from using it immediately.

Territory

Bookbeach provides its services worldwide, due to collaborations with third parties and subsidiaries legal entities. Notify that some regions may have different legal status and some terms and conditions may have differences. Continuing the use of this App the acceptance of the terms is taken for granted.

Introduction

Bookbeach.app (the "App") is made available by "Book Beach International PC", a Greek registered Company, located in Athens, Eleftheriou Venizelou 13 (Nikaia), (tax number 801381260). Our Registered Charity Number is 155596407000.

You, the user of the App, confirm your acceptance of these terms of use ("Terms"). If you do not agree to these application Terms, you must discontinue its use. These application's Terms should be read alongside our Privacy Policy and Cookie Policy.

Use of bookbeach.app is permitted for personal, non-commercial purposes only. You may not copy or make commercial use of our App, its contents, or any processes underlying them without or prior written consent.

Entire Agreement

These terms and conditions and any other legal notices, policies and guidelines of Bookbeach.app linked to these terms and conditions constitute the entire agreement between you and Bookbeach relating to your use of this App and supersede any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter.

Modification of Terms

Bookbeach may change these terms and conditions at any time without advance notice. Changed terms will become effective once posted on the App, and will not have any retrospective effect on existing contractual arrangements made through this App. Your continued use of this App after any change means you have accepted the changed terms and conditions.

Concepts - Definitions / Procedure & Terms of Service

With regard to the terms and conditions of use of the app's services and the procedure of making online reservations, the following apply:

Bookbeach.app

Is a platform for making online reservations at contracted enterprises, which reservations may be accompanied by exclusive discounts or privileges in accordance with the terms and conditions hereof.

Electronic Reservation (or Online Reservation)

The successful completion of the electronic reservation procedure through the application by a user. The electronic reservations are FREE of charge.

Attendance / Completion of Reservation

Upon the attendance of the recipient on the Date/Time of Reservation at the third party, the recipient is required to give their name to the Reservations Manager of the third party or the reservation code.

Cancellation of the Reservation by the User

The user, after making a reservation, has the right to cancel. Cancelling a reservation can only be done until the time of the arrival at the third party and does not burden the users.

Cancellation by the Third Party or Bookbeach

In some extreme cases, where a third party is full unexpectedly or does not allow the bookbeach's reservations services, in cases of private hires or it is closed due to force majeure, the third party or bookbeach has the right to cancel any reservations informing the user in a reasonable amount of time.

No Show

The online reservation that has not been cancelled and the persons who made it do not show up at the third party under the terms and condition of the reservation, i.e. within half an hour from the scheduled Time of Arrival on the date of the reservation. Repeated instances of no-show, i.e. three (3) no shows within six (6) months shall result in the deletion of the User as member from the application.

Special Offer

The offer of products, benefits and services by a contracted company to the members of the application at discount or exclusive prices. The Special Offers rotate at regular intervals on the application.

User

Every member of the application who makes use of the application's services. Only adults (over 18 years of age) can use the application.

Disclaimer of Warranties and Limitation of Liability

Your access to and use of software and other materials on, or through, this App is solely at your own risk. We make no representation, warranty or covenant whatsoever about the reliability, stability or virus free nature of such software.

The Company is responsible for the truth, validity and the completeness of the information provided through BookBeach.

To the maximum extent permitted by applicable law, Bookbeach disclaims all representations, warranties and covenants relating to the information, software, products and services contained in this App. All such information, software, products and services are provided "as is" without representation, warranty or covenant of any kind.

Limitation of Liability

The Company shall not be liable to the members for the quality of services provided by contracted companies or damages that may arise during the execution or not of their order. The existing contractual relationship governs the contracted parties and in this case the users of bookbeach.app and the contracted companies, and only them.

Bookbeach does not guarantee that the pages, services, options and contents of the application shall be offered uninterrupted, error free or that errors will be corrected.

Indemnity

As a condition of use of this App, you agree to indemnify Bookbeach from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting from your use of this App, including without limitation any claims alleging facts that if true would constitute a breach by you of these terms and conditions.

Links to Third-Parties' Applications

This App may contain links and pointers to Internet sites maintained by third parties. We do not operate or control in any respect any information, products or services on such third-party sites. Third party links and pointers are included solely for your convenience, and do not constitute any endorsement by us.

Limitations on Use

You agree to use this App solely to determine the availability of goods and services and make legitimate reservations with bookbeach.app. You agree to use the App only for personal, non-commercial use.

You agree to not abuse the App. "Abuse" includes, without limitation, using the Application to:

• Defame, harass, stalk, threaten, abuse or otherwise violate others' rights as defined by applicable law.
• Harm or interfere with the operation of others' computers and software in any respect.
• Violate applicable intellectual property, publicity or privacy rights.
• Interfere with or disrupt the App or servers or networks connected to the App.
• Direct bots, spiders, crawlers or any other automated process at Bookbeach.app's computer systems.
• Transmit any information or software obtained through the App, or copy, distribute, or sell works deriving from the App.
• Violate this Agreement in any other manner.

Comments and Users' Material

Only users who have made use of the services of third parties through the application or the app are entitled to submit comments, reviews and ratings on the third parties.

A user gains the right to write its review after 48 hours from the time of reservation and provided that the reservation was not cancelled or was a no-show.

Bookbeach does not bear any responsibility for and does not endorse the content of the comments submitted by users. The Company reserves the right to adjust, reject and delete comments at its own discretion.

Payments

Bookbeach reserves the right to offer additional payment methods and/or remove existing payment methods at any time in its sole discretion. If you choose to pay using an online payment method, the payment shall be processed by our third-party payment service provider(s).

Use of Credit Card

We accept major credit cards issued in countries specified during the booking process. By using a credit/debit card, you agree that you are authorised to do so, and that the card or account holder name provided during the online booking process is correct.

Intellectual Property Rights

All trademarks, copyright, database rights and other intellectual property rights in the content and materials included on the App, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software are the property of Bookbeach, its affiliates or its content suppliers and is protected by international trademark copyright and database laws and treaties around the world.

Online Dispute Resolution

In the event of any dispute with regards to your booking with bookbeach.app, if you're a consumer within the European Union and you purchased a product or a facility online you may request the resolution of such a dispute through the European Online Dispute Resolution Platform (ODR Platform).

Applicable Law

These Terms and Conditions and any amendment or alteration thereto shall be governed and supplemented by the Territories' Law. Any provision of the above terms that is contrary to the law, ceases automatically to be valid and is removed from the present, without affecting in any way the validity of the remaining terms.

The courts of Athens have jurisdiction over any dispute arising.
